Employee Smoking Policy Template (Copy & Customize)

Set clear guidelines for smoking in the workplace to support a healthier, compliant, and more respectful work environment. 

Purpose

The purpose of this Employee Smoking Policy is to ensure a safe, healthy, and respectful working environment for all employees by regulating smoking behaviors in accordance with applicable federal, state, and local laws. This policy is designed to promote employee wellness and reduce health risks associated with smoking and secondhand smoke exposure. 

Scope

This policy applies to all employees, contractors, visitors, and vendors at all company-owned or leased facilities, including vehicles and remote work environments where others may be impacted. 

Designated Smoking Areas

Smoking is permitted only in clearly marked designated smoking areas, which are located [insert locations, if applicable]. These areas are positioned away from main entrances, windows, and ventilation systems to prevent smoke from entering indoor spaces.

Employees must use only the designated areas during scheduled breaks and must properly dispose of smoking materials in designated receptacles. Smoking outside these areas is strictly prohibited.

Prohibited Substances

This policy applies to the use of all forms of smoking and tobacco products, including but not limited to: 

  • Traditional cigarettes 
  • Cigars 
  • Pipes
  • Electronic cigarettes (e-cigarettes) 
  • Vaporizers 
  • Smokeless tobacco (chewing tobacco, snuff, etc.) 

The use of any controlled substance, regardless of its method of consumption or legality in certain jurisdictions, is strictly prohibited on company property. 

Disciplinary Action

All employees are expected to adhere to the provisions of this policy. Violations will be addressed in accordance with the company’s disciplinary procedures, which may include: 

  • Verbal or written warnings
  • Suspension without pay
  • Termination of employment in cases of repeated non-compliance 

Managers are responsible for monitoring compliance and addressing issues promptly and fairly.

Employee Acknowledgment

All employees must sign the Employee Smoking Policy Acknowledgment Form upon hire and whenever the policy is updated. The signed form will be kept in the employee’s personnel file as confirmation of their understanding and agreement.
